These Terms of Use ("Terms") govern your access to and use of the Opengreencard website, applications, and related services (collectively, the "Service"). By accessing or using the Service, you agree to these Terms.
1. Who We Are
The Service is operated by Opengreencard LLC ("Opengreencard," "we," "our," or "us"). You can contact us at privacy@opengreencard.com.
2. Purpose of the Service
Opengreencard provides tools to help users organize information, upload documents, and generate immigration-related forms, packet materials, and PDFs, with an initial focus on marriage-based green card and adjustment-of-status workflows.
The Service is intended to support self-directed form preparation and document organization. It is provided for informational, administrative, and document-preparation purposes only.
3. Not Legal Advice
Opengreencard is not a law firm and does not provide legal advice, legal representation, or legal services. Your use of the Service, including any communications with us, does not create an attorney-client relationship.
Any forms, explanations, checklists, or generated materials provided through the Service are for general informational use only and are not a substitute for advice from a qualified immigration attorney.
4. Eligibility
You may use the Service only if you can form a legally binding agreement under applicable law. By using the Service, you represent that you meet this requirement and that all information you provide is truthful and accurate to the best of your knowledge.
5. Your Account and Responsibilities
You are responsible for:
- maintaining the confidentiality of your login credentials;
- ensuring that information you provide through the Service is accurate, current, and complete;
- reviewing all generated forms, PDFs, and filing materials before signing, submitting, or relying on them; and
- determining whether you need advice from a licensed attorney or other professional.
You are responsible for all activity that occurs under your account unless caused by our failure to use reasonable security measures.
6. Acceptable Use
You agree not to:
- use the Service for any unlawful, fraudulent, or misleading purpose;
- upload malicious code, malware, or harmful content;
- interfere with or disrupt the integrity, security, or operation of the Service;
- attempt to gain unauthorized access to accounts, systems, or data;
- scrape, copy, or reverse engineer the Service except as allowed by law; or
- use the Service to violate the rights of others.
7. Immigration Filings and User Review
You remain solely responsible for reviewing all information, forms, supporting evidence lists, and generated outputs before filing anything with USCIS or any other government authority. We do not guarantee that any form, filing packet, or document generated through the Service will be complete, error-free, accepted, or approved.
Government forms, filing requirements, fees, agency interpretations, and processing practices may change without notice. You are responsible for confirming the current requirements that apply to your case.
8. User Content
You retain ownership of the information, documents, images, and other materials you upload or submit through the Service ("User Content").
You grant us a limited, non-exclusive license to host, store, reproduce, process, and transmit User Content solely as necessary to operate, maintain, secure, and improve the Service, and as otherwise described in our Privacy Policy.
You represent that you have the rights needed to upload and use any User Content you provide through the Service.
9. Intellectual Property
The Service, including its software, text, design, branding, and underlying technology, is owned by Opengreencard LLC or its licensors and is protected by applicable intellectual property laws. Except for the limited right to use the Service under these Terms, no rights are granted to you.
10. Service Changes and Availability
We may modify, suspend, or discontinue any part of the Service at any time, with or without notice, including to improve reliability, security, compliance, or usability.
We do not guarantee that the Service will always be available, uninterrupted, secure, or error-free.
11. Free Service
The Service is currently offered free of charge. We may introduce paid features or services in the future. If we do, we will present any applicable terms before charging you.
12. Disclaimers
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the Service will meet your needs, that generated materials will be legally sufficient for your circumstances, or that use of the Service will lead to any immigration benefit or outcome.
13. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, OPENGREENCARD LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS ($100) OR (B) THE AMOUNT YOU PAID US, IF ANY, FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.
14. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Opengreencard LLC and its affiliates, personnel, and service providers from and against claims, liabilities, damages, judgments, losses, and expenses arising out of or related to your misuse of the Service, your User Content, or your violation of these Terms or applicable law.
15. Termination
You may stop using the Service at any time. We may suspend or terminate your access to the Service if we reasonably believe you have violated these Terms, created security or legal risk, or misused the Service.
Sections that by their nature should survive termination will survive, including ownership, disclaimers, limitations of liability, indemnification, and dispute-related provisions.
16. Governing Law and Venue
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.
Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in California, and you consent to the personal jurisdiction of those courts.
17. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we may provide notice through the Service or by other reasonable means. Your continued use of the Service after updated Terms become effective means you accept the revised Terms.
